RECENT NEWS AND IDEAS FROM CBINSOLVENCY – May 2019

TO THE MEMORY OF OUR FRIEND AND COLLEAGUE, GABRIEL MOSS, QC
This CBI newsletter is tinged with sadness.  In October 2018, Dan Glosband was asked by Gabriel Moss, QC (South Square Chambers) to contribute an article to a special issue of Insolvency Intelligence that would honor Ian Fletcher, who passed away in July of 2018.  Ian was a professor emeritus at University College London, one of the world’s leading scholars of commercial and insolvency law and especially cross-border insolvency law, a prolific author and one of the nicest human beings I ever met.  He and Gabriel were editors of Moss, Fletcher and Issacs on The EU Regulation on Insolvency Proceedings (Ian was an academic member of South Square Chambers).  The attached article, Update on Third-Party Releases in Chapters 15 and 11 (including a brief reminiscence of Ian), was Dan’s submission.

The article was published in February.  Sadly, not long thereafter, we learned of the sudden death of Gabriel Moss on March 15, 2019. While Gabriel was recognized as a foremost authority in the insolvency world, his South Square colleagues hit the mark when they said “He was imaginative and unflappable, innovative and affable, supremely intelligent and utterly approachable.”
